This Refund & Cancellation Policy (“Policy”) governs all payments made to Startupwala Pvt. Ltd. (“Startupwala”, “Company”, “we”, “us”) for services offered through its technology platform.
By making any payment or availing services, you acknowledge and agree to this Policy.
2. Nature of Services
Startupwala operates as a technology-enabled facilitation platform.
- We are not a law firm, CA firm, CS firm, Trademark Agent, or Government authority
- We do not provide legal or professional advice
- We do not represent clients before any authority
All filings, representations, certifications, or professional actions (where required) are carried out exclusively by independent, duly qualified professionals as per applicable laws.
Use of this platform does not create any professional-client or fiduciary relationship.
3. No Guarantee / Outcome Disclaimer
Startupwala does not guarantee:
- Registration, approval, or certification
- Timelines
- Objection-free processing
- Final outcome of any application
All decisions are made solely by:
- Government authorities (such as ROC, MCA, IP India, GST authorities, etc.)
- Regulatory bodies
- Independent professionals
Fees are charged for facilitation, documentation, coordination, and process management, and not for outcomes.

Payments made to Startupwala may include:
- Facilitation Fees (Startupwala)
- Government Fees / Statutory Charges
- Professional Fees (Independent CA/CS/Advocate/Trademark Agent)
- Third-party Costs (if applicable)
Each component is distinct and governed separately under this Policy.

5.1 Before Work Commencement
Cancellation requests may be considered only if:
- No work has been initiated internally
- No professional has been engaged
- No document processing has started
In such cases, administrative and payment gateway charges will be deducted.
5.2 After Work Commencement
Once any of the following has occurred, cancellation is not permitted:
- Consultation or advisory interaction
- Document review or drafting
- Name search or eligibility analysis
- Assignment to professionals
- Internal processing or workflow initiation
5.3 After Filing / Submission
No cancellation shall be permitted once:
- Application is filed with any authority
- Documents are submitted for processing
- Work has reached execution stage
6. Refund Policy
6.1 Facilitation Fees (Startupwala)
- Non-refundable, once work has commenced
- Partial refund may be granted only at the sole discretion of the Company in exceptional cases
6.2 Government Fees
- Strictly non-refundable under all circumstances
- Governed by respective Government rules
6.3 Professional Fees
- Paid to independent professionals
- Non-refundable, once assigned or engaged
6.4 Rejection / Objection / Delay Cases
No refund shall be provided for:
- Rejection by authorities
- Trademark objections or oppositions
- Delays due to Registry or Government backlog
- Change in law or regulatory requirements
These are external factors beyond the control of Startupwala.
7. Conditional Refund Commitments
Any explicit refund assurance (for example, conditional refund offers) shall apply only if:
- Clearly stated in writing in the service proposal or product page
- All stated conditions are strictly fulfilled
Such commitments are service-specific and do not form part of the general policy.
8. User Responsibility
No refund shall be applicable if:
- Incorrect or incomplete information is provided
- Required documents are delayed or not submitted
- The user is unresponsive during the process
- Instructions are not followed
User cooperation is essential for successful facilitation.
9. PMLA / TCSP Compliance Disclaimer
Startupwala may act as a Trust and Company Service Provider (TCSP) and comply with applicable obligations under:
- Prevention of Money Laundering Act, 2002 (PMLA)
- Applicable Rules and FIU-IND reporting requirements
Accordingly:
- KYC and verification may be mandatory
- Transactions may be delayed, restricted, or declined due to compliance requirements
- Refunds may be withheld or restricted where required by law
Such actions shall not be considered a service deficiency.
10. Payment Disputes and Chargebacks
Initiating chargebacks without valid grounds may result in:
- Suspension of services
- Legal recovery action
Users are encouraged to resolve concerns through official support channels before initiating any dispute.
11. Mode and Timeline of Refund
- Approved refunds, if any, shall be processed to the original payment method only
- Processing time is typically 7 to 10 working days, subject to banking and payment gateway timelines
12. Limitation of Liability
To the maximum extent permitted by law, Startupwala shall not be liable for:
- Any indirect, incidental, or consequential loss
- Loss due to Government decisions or delays
- Professional advice rendered by independent professionals
13. Jurisdiction
All disputes shall be subject to the exclusive jurisdiction of courts in Pune, Maharashtra, India.
14. Policy Updates
Startupwala reserves the right to modify this Policy at any time without prior notice.
Continued use of services shall constitute acceptance of the updated Policy.
